YCK Laneways x DOBBY Concert Terms and Conditions
The promoter is: Kreate Australia ABN 75 121 793 306 whose registered office is Bottlebrush Place LITTLE MOUNTAIN QLD 4551 on behalf of their client YCK LANEWAYS ASSOCIATION INC, ABN 42 556 566 166, whose registered office is at 181 Mullens St, Rozelle, 2039.
The competition is open to residents of New South Whales, Australia aged 18 years or over except employees of Kreate Australia and their close relatives and anyone otherwise connected with the organisation or judging of the competition and YCK Laneways members and YCK Laneways Committee members.
There is no entry fee and no purchase necessary to enter this competition.
By entering this competition, an entrant is indicating his/her agreement to be bound by these terms and conditions.
The rules of the competition and how to enter are as follows:

Closing date for entries will be 12:00pm on the 30th of November 2023. After this date, no further entries to the competition will be permitted.
Entrants warrant that their entry does not infringe the intellectual property rights of any third party.
No responsibility can be accepted for entries not received for whatever reason.
Any changes to the competition will be notified to entrants as soon as possible by the promoter.
The promoter is not responsible for inaccurate prize details supplied to any entrant by any third party connected with this competition.
The prize is as stated, and no cash or other alternatives will be offered. The prizes are not transferable. Prizes are subject to availability and we reserve the right to substitute any prize with another of equivalent value without giving notice.
Bookings with competition partners are subject to availability.
The 2 winners will be chosen at random by the Promoter.
The winner will be notified by email within 24 hours of the closing date. If the winner cannot be contacted or do not claim the prize within 1 day of notification, we reserve the right to withdraw the prize from the winner and pick a replacement winner.
The promoter will notify the winner when and where the prize can be collected/is delivered.
The promoter’s decision in respect of all matters to do with the competition will be final and no correspondence will be entered into.
The competition and these terms and conditions will be governed by Australian law and any disputes will be subject to the exclusive jurisdiction of the courts of Australia.
The winner agrees to the use of his/her name and image in any publicity material. Any personal data relating to the winner or any other entrants will be used solely in accordance with current Australian data protection legislation and will not be disclosed to a third party without the entrant’s prior consent.
The competition, run by Kreate Australia, is in no way sponsored, endorsed, administered by or associated with Instagram and Facebook.

TERMS AND CONDITIONS
1. Instructions on how to claim and the reward form part of these Terms and Conditions. Participation in this offer is deemed acceptance of these Terms and Conditions. Offer not valid in conjunction with any other offer.
2. Claims are only open to individuals aged 18 years or over.
3. Employees (and their immediate families) of the Promoter and agencies associated with this offer are ineligible to claim. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
4. Offer is only available whilst advertised. Promoter reserves the right to withdraw the offer at any time.
5. To be eligible to claim a reward, individuals must sign up to the YCK Laneway Loyalty Program (if not done so already) at https://ycklanewaysmap.com.au/auth/. To sign up, individuals must create an account with a valid email address.
6. To claim a reward, individuals must collect a total of five (5) Loyalty Points within their account to redeem the reward of a free drink (“Reward”).
How to earn Loyalty Points:
Attend an event being held at any YCK Laneways venues and ask the staff for the Event QR code. Scan the Event QR code while logged into your Laneways Loyalty account and earn 1 Loyalty Point; or
Purchase one (1) of the listed drink specials at a YCK Laneways venue and ask the staff for the Specials [kS2] QR code. Scan the Specials QR code while logged into your Laneways Loyalty account and earn 1 Loyalty Point.
For clarity, each YCK Laneways venue will have two (2) QR Codes on-site, an Event QR Code that can be scanned when attending an event within the particular YCK Laneways venue or a Specials QR Code that can be scanned when purchasing a drink from the Specials drinks list at the particular YCK Laneways venue.
Once an individual has collected five (5) Loyalty Points, they can then redeem a Reward at any YCK Laneways venue. Please note guests must adhere to the YCK Laneway Loyalty Program terms and conditions which can be found via www.ycklaneways.com.au/terms[AM3] .
7. Only one (1) Event QR code and one (1) Specials QR Code can be scanned per person per YCK Laneways venue in a 24hour period.
8. The Promoter reserves the right, at any time, to verify the validity of claims and claimant’s (including a claimant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the claim process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the Offer. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
9. Incomplete or illegible claims will be deemed invalid.
10. Only one (1) claim for a Reward is permitted per person per day.
11. If there is a dispute as to the identity of a claimant, the Promoter reserves the right, in its sole discretion, to determine the identity of the claimant.
12. The Promoter’s decision is final and no correspondence will be entered into.
13. Every valid claim received will be awarded one free drink from the specials listed at a YCK Laneways venue.
14. Entry and continued participation in this offer is subject to the licensee’s liquor serving policy. The Promoter advocates the responsible service and consumption of alcohol.
15. Any ancillary costs associated with redeeming the Reward are not included.
16. If for any reason a claimant does not redeem a Reward by the time stipulated by the Promoter, then the reward will be forfeited.
17. If the Reward is unavailable, the Promoter, in its discretion, reserves the right to substitute the Reward with a reward to the equal value and/or specification.
18. Rewards are not transferable or exchangeable and cannot be taken as cash.
19. If this offer is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any claimant; or (b) to modify, suspend, terminate or cancel the offer, as appropriate.
20. Any cost associated with accessing the YCK Laneway Loyalty Program website/account is the claimant’s responsibility and is dependent on the Internet service provider used.
21. The use of any automated software or any other mechanical or electronic means that allows a claimant to automatically claim repeatedly is prohibited and will render all claims submitted by that claimant invalid.
22. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the offer.
23. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in reward value to that stated in these Terms and Conditions; (e) if an event at a YCK Laneway venue is delayed, postponed or cancelled for any reason beyond the reasonable control of the Promoter; (f) any tax liability incurred by a claimant; or (g) use of the Reward.
24. The Promoter collects personal information ("PI") in order to conduct the offer and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers and Reward suppliers. Participation is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at https://www.ycklaneways.com.au/privacy. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the claimant. The Privacy Policy also contains information about how claimants may opt out, access, update or correct their PI, how claimants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All claims become the property of the Promoter. The Promoter will not disclose claimant’s personal information to any entity outside of Australia.
